Tom Allen QC successfully defended Benedikt Sobotka, the CEO of ERG (parent company of ENRC) in SFO proceedings for failing to comply with a requirement to attend a s.2 interview. Mr Sobotka argued that (i) the SFO did not have extra territorial powers to compel him to return to the jurisdiction to face questioning under compulsion (and possible criminal sanction); and (ii) that he had no obligation to comply with the notice in any event, when he was outside the jurisdiction.
